(New) Quixtar request for TRO denied. In an effort to circumvent Judge Barret’s order in Georgia enjoining Quixtar from suing the plaintiffs in arbitration, Quixtar moved for a TRO in California. They were denied.
(New) Texas Judge rules Quixtar arbitration invalid. In the Simmons IBO case, the Honorable Judge Bush from the Eastern District of Texas ruled that Quixtar’s arbitration process is invalid for multiple reasons. Quixtar will have to pursue its case against Mr. Simmons in a public forum.
